On 26 October 2024, the Local Government (Governance and Integrity) Amendment Regulations 2024 introduced a requirement for all Councillors to observe the new ‘Model Code of Conduct’.
This Model Code of Conduct replaces the previous statutory requirement for each Council to develop its own Councillor Code of Conduct.
The Model Code of Conduct aims to strengthen the working relationships between Councillors through establishing clear standards for the behaviour and responsibilities of Councillors. The Model Code recognises the importance of cooperation and constructive collaboration in promoting effective performance of Councillors’ duties, prioritising the wellbeing of the municipal community, and strengthening public confidence.
Before assuming office, Councillors must take an oath or affirmation of office, declaring that they will abide by the Model Code of Conduct and uphold the standards of conduct set out in the Model Code of Conduct.
Councillors are personally responsible for complying with the Model Code of Conduct in the performance of their role and must uphold the standards of conduct contained in the Model Code by promoting and supporting the Model Code at all times and encouraging others to follow their example in doing so.
Failure by a Councillor to comply with the Model Code of Conduct constitutes misconduct under the Local Government Act 2020.
